Can Apple survive without Steve Jobs?

A friend e-mailed me recently, complaining about his new iPhone 4S. He?d been trying to set up a shared calendar with his wife and ended up so confused he had to consult the product manual. ?I?ve never had to do that with an Apple product before,? he wrote.

Given that Apple has long been known for its clean and intuitive graphical user interface, my friend?s experience raises a question that?s been asked a lot since Apple co-founder Steve Jobs died in October: Can the brand?s core attributes be protected without him?

We won?t know for a while, although there?s been rampant speculation about what aspects of Jobs?s leadership will be missed the most. He was famous for being a control freak, for example, his fingerprints on every stage of product development. Tim Cook was appointed as CEO last August, yet even Jobs noted that Cook isn?t really a ?product guy.? Then there?s the charisma factor. Jobs was both loved and feared, and his style kept Apple management on its toes.

Cook, by all reports, isn?t the screaming kind. So maybe the Apple workplace will be a little more relaxed, but also less motivated to shine without the hovering threat Jobs once represented.

In fact, it was Jobs himself who stated most clearly what Apple would lose when he was gone. In a 1995 interview with veteran tech journalist Bob Cringely, re-released after Jobs?s death, he said two very notable things. The first is his now-famous quip that ?the only problem with Microsoft is they just have no taste.? The second, in a more reflective moment, came when Jobs observed, ?People like symbols. So I?m the symbol for certain things.?

The interview took place two years before Jobs returned to Apple, which had struggled after he was ousted in a boardroom showdown in 1985. What he understood, even before he rejoined the company, was that his personal style would lead Apple to get certain things right again: the look and feel of the product, the mystique around product release, the cheeky opposite-of-Microsoft/IBM marketing and, of course, those brilliant product choices. A music player just when one was required. A cool phone just when phones got smart. A tablet just when computer design seemed to have grown static. Those were products of his taste and his personal energy, and Jobs himself would become their unifying symbol.

That personality transfer put a human aura back around Apple products. As branding experts will tell you, it?s the brands that acquire the qualities of human personality that grip the consumer imagination firmly. Apple did that, and it was able to do it because of Jobs. The absence of the charismatic control freak, the feared leader, may present challenges to the company, but the absence of his personality will be the most problematic. Without its human symbol, the brand will become more vulnerable to competitors.

Nothing highlights that better than the viral success of a new commercial from Samsung that hit the Internet in November. The ad mocks rabid Apple fans waiting in line for a chance to purchase their product by showing their ill-concealed envy at the sight of a larger 4G phone by Samsung. Their devotion to the Apple brand is shown to be ludicrous if you only consider product features.

Which returns us to my friend?s issues with his iPhone 4S. It isn?t so important that Jobs didn?t supervise every stage in its development, which overlapped his illness. What?s critical is that it?s the first Apple product marketed in the absence of the affirming presence of Jobs himself. Without Jobs, it?s just a phone.

That loss of Jobs?s aura, haloing Apple?s products with good taste, will be the heaviest.

Newt Gingrich cries while recalling late mother

(AP) ? Newt Gingrich choked up and wiped away tears Friday while recalling his late mother's struggle with depression and mental illness.

Speaking at an event with mothers in Des Moines, Iowa, the former House speaker said his focus on brain science issues stems directly from "dealing with the real problems of real people in my family."

"And so it's not a theory. It's, in fact, my mother," he said as he wiped away tears.

Kit Gingrich died in 2003 at age 77. Gingrich said she spent her final years in a long-term care facility suffering from depression, bipolar disease and gradually acquired physical ailments.

The moment was reminiscent of Hillary Rodham Clinton's teary-eyed response to a question just before the 2008 Democratic primary in New Hampshire. That rare, emotional response by the former first lady was credited with humanizing her in the eyes of voters. She went on to pull off a win in the state.

After showing his emotions, the cerebral Gingrich said he does "policy much easier than he does personal."

His wife, Callista, and two daughters, were in the audience.

"Callista will tell you I get teary-eyed every time we sing Christmas carols," Gingrich said.

Gingrich has fallen in recent Iowa polls, with the state's caucuses just several days away. He is in the midst of a 22-stop bus tour across the state.

U.S. says China not currency manipulator; chides Japan (Reuters)

WASHINGTON (Reuters) ? The U.S. Treasury again shied away from labeling China a currency manipulator on Tuesday, but it rapped the country for not moving quickly enough on exchange rate reforms.

The United States also chided Japan for stepping into the currency market to stem the yen's rise, and urged South Korea to use such interventions sparingly.

Some U.S. politicians have argued that China has gained an unfair competitive edge in global markets by keeping the yuan artificially low to boost exports, and pressure has mounted in Congress for President Barack Obama to punish China.

But the administration prefers to tread softly and use diplomacy. The U.S. Treasury, in a semi-annual report, as usual said that statutes covering a designation of currency manipulator "have not been met with respect to China."

It repeated its standard line that appreciation in the yuan has been too slow, calling it "insufficient."

"Treasury will closely monitor the pace of appreciation and press for policy changes that yield greater exchange rate flexibility, a level playing field, and a sustained shift to domestic demand-led growth," it said in the report to Congress on international economic and exchange rate policies.

The value of the yuan, which Beijing manages closely, has risen 4 percent against the dollar this year and 7.7 percent since China dropped a firm peg against the greenback in June 2010. The Peterson Institute for International Economics recently estimated the yuan was undervalued by 24 percent against the dollar, down from 28 percent earlier in the year. It attributed the change to both Beijing's policy of gradual currency appreciation and higher Chinese inflation.

At the heart of the friction between the two countries is a U.S. trade deficit with China that swelled in 2010 to a record $273.1 billion from about $226.9 billion in 2009. The cumulative Jan-Oct deficit with China is on track to top that this year, running at around $245.5 billion.

The U.S. Senate this year for the first time passed a bill that would require the administration to slap penalties on Chinese imports if it fails to adopt market-based exchange rates. While the measure has made no progress in the lower chamber and is unlikely to become law, it shows the mounting U.S. frustration with its vital trade partner.

President Obama at the November APEC meetings, in his toughest words yet, told President Hu Jintao that China must play by global trade rules and act like "a grown-up."

The Treasury's decision not to label China a currency manipulator sent a "clear and positive signal" that would soothe the market and benefit trade, according to a commentary in Xinhua, the Chinese state news agency, on Wednesday.

Beijing has warned the United States not to "politicize" the currency issue, and some economists have pointed out that nations such as Japan and Switzerland have intervened in currency markets without drawing Washington's ire.

TARGETING TOKYO

The report did point the finger at Japan this time, criticizing Tokyo for its solo yen-selling interventions in August and October that followed a joint Group of 7 action in the aftermath of the March 11 earthquake.

"The unilateral Japanese interventions were undertaken when exchange market conditions appeared to be operating in an orderly manner and volatility in the yen-dollar exchange rate was lower than, for example, the euro-dollar market," the report said.

"In contrast to the post-earthquake joint G7 intervention in March, the United States did not support these interventions," the Treasury said, adding that Tokyo should pursue reforms to revive its domestic economy rather than try to influence the exchange rate.

A senior Japanese government official said the report did not change Tokyo's position that its currency policy was in line with G7 agreements.

"This report does not make it more difficult for Japan to intervene," said the official, who spoke on condition of anonymity due to the sensitivity of the topic. "We are committed to doing whatever is necessary."

Japanese exporters have complained that the ultra-strong yen puts them at a competitive disadvantage. The yen was trading at just under 78 to the U.S. dollar on Wednesday morning, about 3 percent weaker than it was on October 31, when Tokyo aggressively intervened to cap the rise.

The report also noted that South Korean authorities "should limit their FX interventions to exceptional circumstances of disorderly market conditions and adopt a greater degree of exchange rate flexibility."

Treasury Secretary Timothy Geithner has said the law on the FX report, which requires the administration to determine whether U.S. trade partners are deliberately undervaluing their currencies, is a poor tool to push Beijing on the yuan.

Instead, the United States prefers to argue for change at regular closed-door meetings with Chinese officials. It also uses international economic forums, such as the Group of 20 leading nations and the International Monetary Fund, to ramp up public pressure on Beijing to move more quickly to a more-flexible currency.

China is the biggest foreign holder of U.S. Treasuries, with about $1.1 trillion, a position that gives it leverage in international economic negotiations. Foreign exchange traders had not expected a change of U.S. tactics.

"It's not very surprising. It's sort of sliding it in under the radar. They're (Treasury) really not in a position to make any major moves at this point," said Sean Incremona, an economist at 4Cast in New York.

The Treasury Department has not labeled a country a currency manipulator since July 1994, when it cited China. A designation would require the United States to step up negotiations with Beijing on the yuan's value.

The yuan slipped on Tuesday as strong dollar demand from corporations offset a record high mid-point fixed by the People's Bank of China. The central bank set an all-time high dollar/yuan mid-point in an apparent move to let the yuan rise a little more at the end of 2011 so as to make the yuan's full-year nominal appreciation look bigger, traders said.

Some U.S. manufacturers, which have been hit hardest by competition from China and other emerging economies, would still prefer the U.S. government to take a harder line.

"China's currency is still enormously undervalued," said Scott Paul, executive director of the Alliance for American Manufacturing, an industry lobby for hard-hit textile, steel and labor groups.

"I'm disappointed that President Obama has now formally refused six times to cite China for its currency manipulation, a practice which has contributed to the loss of hundreds of thousands of American manufacturing jobs."

Mexico nabs drug lord's security boss

(CNN) -- Mexican army special forces have arrested a top lieutenant for alleged drug kingpin Joaquin "El Chapo" Guzman, the Defense Ministry said Monday.

Troops arrested Felipe Cabrera Sarabia on Friday in "a surgical operation in Cuiliacan" in the northwestern state of Sinaloa, said Ricardo Trevilla Trejo, a Defense Ministry spokesman.

Cabrera, who was responsible for the activities of the Pacific Cartel in Durango and the southern part of the state of Chihuahua, was detained after fleeing from Durango, Trevilla told reporters.

"The analysis of his behavior permitted (us) to find the building where he was hiding" and Cabrera was taken into custody without violence, Trevilla said. Firearms, computer equipment and other documentation were seized, too, he said.

Cabrera, who appeared Monday in the office of a prosecutor who specializes in organized crime, was responsible for Guzman's security in Durango, the state-run Notimex news agency said.

He is charged with possessing firearms reserved for use by the army and falsification of a public document, a spokeswoman for the attorney general said.

Trevilla said Cabrera was involved in kidnappings, extortion and arson.

"The violence caused him to rise within the organization," said Trevilla, who predicted that the arrest will affect the cartel's leadership and abilities.

Guzman, who is under indictment by U.S. authorities in Chicago, New York and Los Angeles, is described by the U.S. Drug Enforcement Administration as one of "the most powerful drug traffickers in Mexico." In 2004, the U.S. government announced a $5 million reward for information leading to his arrest and conviction.

He is accused of running a major network that distributes cocaine and heroin.

He is worth about $1 billion, according to Forbes Magazine, which began listing him on its billionaires list in 2009. The magazine lists him as No. 55 on its Most Powerful People list and as the only crime lord on its list of Mexico's billionaires.

Japan?s Sumally Interviewed by Wired Japan [TRANSLATION]

This article about Sumally was written for WIRED Japan, and I had the opportunity to translate it to English. Sumally has been covered before on PO, so consider this an update of sorts to the previous article. Sumally is an encyclopedia of all products. People can Want or Have any product that they come across online and archive them in a single unified format. The total number of Wants and Haves on Sumally has exceeded one million, and the number of items archived has surpassed 200,000.

Here is the article below, with comments from me indicated by italics.

Sumally, the new online service where Tokyo?s top creative talent are sharing their Wants and Haves, started from a desire to create an all-encompassing online encyclopedia of products. Here is what the four leading members of this exciting new service have to say.

Sumally is a new social networking service aiming to become the ?Encyclopedia of Products.? Kensuke Yamamoto, the CEO of Sumally, left his position as a magazine editor to become an entrepreneur and to pursue his vision of creating a place where users can catalog every product they ever wanted or had. He was joined by well-known web designer Yugo Nakamura, and together with Nakamura?s employees, design director Hideki Oowa and software engineer Keita Kitamura, they are working hard to create an online experience that will be successful at an international level. As the team prepares to release the next milestone for their service, which will allow users to buy and sell products on the site, our WIRED editorial team sat down with the Sumally team to share and discuss their ideas, hoping to find out how Sumally will help shape the technology driven future.

The entire interview lasted more than an hour, split between serious discussions about Sumally?s vision, hardships the team endured, creative solutions to get around them, and plenty of laughter.

Won awards for Japan Media Arts Festival, Tokyo Interactive Award, and ARS Electronica.

Can you tell us what Sumally is about, and the concept behind it?

? While I was an editor for a magazine, I started thinking about creating a ?Wikipedia for Products?. Not only am I in love with products of all sorts, but I also realized that even mainstream products, such as Leica cameras, Nike sneakers, Louis Vuitton bags, Comme des Garcons clothes, are not cataloged in an openly available format. This is a serious loss for our society, and it was clear to me that I had to create a universal format for archiving product meta data.

So, instead of creating a magazine, I moved on to creating an encyclopedia of all products. And instead of just having a picture and description of the product, like any modern encyclopedia in year 2010 should have, I decided that it was important that information such as who wants it, who has it, and who is selling it was also included. Furthermore, a system had to be in place to make the cataloging process simple.

Users have pulled down different products from different places online. Some of the commonly seen websites include Amazon, and fashion websites such as Mr.Porter and ZozoTown. I came across products from Esty too.

Mr. Nakamura, what was your first impression when you heard of Mr. Yamamoto?s idea?

Yugo ? Many online services are started by ?geeks?, or some sort of specialist involved in the domain of the service. They start small, and gradually become big. It was exciting to see an editor of magazine, someone in a completely different field, to want to start a new web-based online service. He was all smiles when he first came to talk to me, and announced ?I want to be the Japanese Zuckerberg.? At first I was speechless, but the idea seemed interesting, and thought that his idea just might work. I then spread the word to Hideki and Keita, both of whom were involved in creating UNIQLOOKS, and we all decided to give it a shot.

How about you, Mr. Oowa?

Hideki ? While we did pretty well with UNIQLOOKS, I had a gut feeling that we could go further in terms of designs and structure. That?s when the idea of Sumally came along. The fact that it was a startup and not a big enterprise was appealing, and Kensuke?s passion convinced me that the project was indeed feasible. Despite the hardships that comes with it, building a new online service from scratch is really exciting in a different way from creating advertisements.

And you, Mr. Kitamura?

Keita ? While our design work at tha is mostly for advertisements, I have always wanted to create an online service as well. So, Keita?s proposal came at the perfect timing. I was excited that I will finally be able to build my own online service. As Hideki mentioned, with advertisements, once it?s finished it is out in the open, and that is the end of it. On the other hand, building an online service allows to continually attract and build up a customer base, which is what I was looking for. I actually feel that suites my character better!

When investors make the judgement to support a startup, they look at the idea or the potential market size, but more importantly, they look at the team. The Sumally team is unique in the sense that they are not from the high tech industry which gives them a fresh eye. The uniqueness of the team can be confirmed by looking at the simple and sleek design of the website and its newly released iphone application.

?Advertisement is a short film, Service is a Soap Opera?

What is the difference between creating websites for advertisement and creating websites for an online service?

Yugo ? Advertisement is a one-shot deal like creating a short film or a movie. An online service, on the other hand, continues even after it?s released, more like a soap opera. Of course, not everyone can contribute to both kinds of website development. While developing an online service is interesting to me, I tend to lose focus when working on one project for a long time. Hideki and Keita prefer developing an online service though.

Hideki ? The line between an advertisement and an online service is becoming increasingly thin, especially since modern online advertisements require an interactive social networking feature. The difference lies in the amount of time the content needs to be relevant, and much higher level of passion and vision is required to maintain an online service that will disappear like one-shot advertisements. Furthermore, while advertisement projects come with a budget, building your own online service requires us to attain funding. Fortunately for us, Kensuke, with his passion and determination, has been able to deliver the funding we have needed.

Sumally has just started its journey. There are many online services that have succeeded in getting the attention upon release, but had difficulty maintaining user interest. Each and every decision they make will either engage users more possibly make them lose interest.

?Creating a truly international online service!?

Can you tell us more about your vision of creating a service that can change the world?!


Kensuke
? My saying that I want to change, not just Japan, but also the world, is a bit of an exaggeration, something I?ve been saying to stand out from the crowd. But I have always been passionate about and have great respect for brands that can make it in the global market. So yes, I do want to build an online service that can succeed outside of Japan. One of the things that I feel might have a chance at succeeding on the international level is the way Japanese people, and especially people living in Tokyo, create brands for specific product categories. A simple combination of a ten dollar t-shirt together with a five dollar skirt and perhaps a twenty dollar pair of shoes is enough to be branded as a specific ?style?, which seems amazing to me. This ability to quickly create recognizable name for a specific product category that represents context as well as interests is something unique to Japan, and something I think we should be proud of. And I am hoping that it will be relevant throughout the world.

Hideki ? Building content that is only relevant in Japan wasn?t what the tha team is about either, so ?Going global? was one of the key elements in deciding to create Sumally together.

Hideki ? Definitely. Of course, since most of our users are Japanese, we have to choose the words we use carefully. We are looking to strike the perfect balance between keeping the site user friendly for Japanese users and making sure that the site is viable in the international market.

Kensuke ? I want our online service to be just as user friendly for non-Japanese users as it is for Japanese users, while making sure that we keep our roots in Japan.

Yugo ? When we say global, we are not talking about the geographical transition from Japan to the rest of the world. Our challenge is whether Sumally can become an infrastructure for people when they talk about products. Online services such as Twitter and Facebook provide infrastructure, while advertisements function on top of such infrastructure. And we are an infrastructure type service.

Kensuke ? Making something fashionable is simple, if I am allowed to say so. But going beyond fashion and reaching sophisticated simplicity that can be appreciated objectively across the board is a totally different matter. That?s why I wanted to team up with Yugo Nakamura who can achieve this both in terms of programing and user interface design. Things have to work whether the product is an animation figure, golf club, or a teapot in order for our online service to be considered an infrastructure.

Making it universal to take it beyond fashionable.

What exactly do you mean when you say ?universal??!

Kensuke ? Magazines are segmented into categories such as street fashion, animation, or Internet related. ?Universal? is when you abandon that categorization based on taste. Until about 5 years ago, people were talking about how mass media would someday become segmented media. My thought at that time was that after segmented media would be ?micro-media collectives?. The ?2ch? online service, which I consider to be one of the best built media, is already structured this way.

In the 2ch system, there are 100 or so top level categories, and under them are 200 or so threads in each category, which makes it highly likely that every visitor will find something interesting. The fact that this simple aggregation of content is functioning as a single medium makes 2ch very powerful. It is my belief that such a platform, where the currently separate worlds of street fashion, animation, and gadgets can coexist, is the required structure for any successful media. This is what I mean by wanting to create something ?universal?.

Hideki ? This concept of being universal is something we have in common with the design concepts at tha. It isn?t the container of content that needs to stand out. Through our designs, we ensure that the content that stands upon the container shines through and looks good.

Kensuke ? That is why we need to build something that is more than just fashionable.

Now that Sumally has been launched, has it been used in a universal manner so far?!

Kensuke ? We?re still in our invite-only beta phase, hoping to start out with mostly influential users with a strong interest in products, and then gradually spreading out the user base. This makes it unlikely that the service is being used universally, but we are accumulating quite a collection of products across a wide range of categories, which is exactly what we were aiming for.

Yugo ? What I found interesting was how much effort Kensuke poured into attracting beta users for the service during the launch. Even many of my colleagues, many of them famous and very influential in their industry, have started to use the service. I really liked the idea of ?start building the people network first?.

Kensuke ? This part is similar to how we start up a magazine.

Keita ? While many people who can develop the system, the type of content you accumulate depends mostly on the people you attract to your service. It was a smart idea to start out by gathering many interesting people. It would be difficult for other startups to do what Kensuke did.

While many popular services penetrate from tech savvy people to mainstream, Kensuke has leveraged his network from his career as a magazine editor. Just by looking through Sumally products, one can meet fashionable and famous stylists and celebrities in different fields. It is similar to the marketing strategy of Ameba, the biggest blogging service in Japan. They succeeded in attracting all sorts of famous celebrities to blog use the service, which in turn brought in the mainstream users. In the case of Sumally, it is mostly because of the passion that Kensuke has that these well-known people have tried out the service.

The next step for Sumally: selling products via ?Social with Commerce?

What is the business model for Sumally?

Kensuke ? A new feature we have in mind is to be able to sell products on Sumally. Most e-commerce works by creating a list of what to sell. We believe that it would be a better user experience if it was the other way around, and users were able to shop from a list. Both real and virtual stores are separate establishments, giving more power to the merchant. Using a universal catalog of products, consumers will be able to indicate and share their wants, and instead of going to buy a product, merchants will come to sell the product. From the merchant?s perspective, instead of having to spend energy on attracting customers to the store, they can simply go to the consumer who is ready to buy. We would then receive a cut of the sale.

Is ?Social Commerce?, which is quickly becoming a buzzword, a category that Sumally belongs to?

Kensuke ? To be honest, I am a bit uncomfortable with the phrase ?Social Commerce?. In my opinion, it is more like ?Social with Commerce?. There are many catalogs that are made to look like a magazine, but everyone can tell that it?s still just a catalog. It is obvious when something is being pitched to you as a sale instead of when they are presented because they are good. Just like we all know that Takuya Kimura, a very famous actor and featured in commercials for the Toyota Carola, does not really drive that car in real life.

Since ?Social Commerce? services are based on the old e-commerce model, I believe that they are limited to just that: what the seller wants to sell. Sumally, on the other hand, is about sharing everything that is interesting. Rather than categorizing the products that are on sale, it is closer to adding an e-commerce feature to the Tumblr service. This is why I feel that ?Social with Commerce? would be a better description of what we are trying to do, than ?Social Commerce?.

The Sumally iPhone application is worth trying out. There is a feed tab where users can see all items shared by people they follow. On my Sumally tab, users can browse through products that they have Wanted or Haved. The Activity tab can be used to find people who have similar tastes as yourself, because you can see who else have Wanted or Haved the products that you have archived on Sumally.

Since it is be impossible to add every feature you can think of, what are the criteria for adding new features to Sumally?

Kensuke ? The most important thing is to have our users keep on using our service. An iPhone app, which is coming soon, will be the first. We also plan to add a feature similar to Facebook Pages for brands and stores. Users would be able to follow a brand and find out about new product arrivals and everything else about that brand. There are many other features that we?re considering, but we will take it one step at a time.

Hideki ? Since the concept of connecting people to products is at the core of Sumally, we want to make it easy for our users to discover other people and other products. New recommendations should flow by constantly, yet painlessly, and we aim to design and implement a best of breed system to make that possible.

Is there anything you would like to share with our readers about the near term plans for Sumally?

Kensuke ? Being able to buy and sell products on Sumally is definitely on the top of our to-do list.

What is the appeal of Sumally for people merchants?

Kensuke ? Since people are sharing what they want, merchants would be able to sell to those particular users who want the products. If there are 5 people who wants a 1,000 dollar Star Wars figure, toy stores all over the world would want to sell there. If 100 people indicated that they want the same pair of sneakers that Kayne West has, Nike would want to sell there.

Hideki ? I really want Sumally to be used all over the world. We are currently still in our beta phase, and most users are still from Japan. The key is how we would expand into markets outside of Japan. Just like we count many influential and taste-leaders from Tokyo as our users, we will have to attract the same kind of users from all over the world, and make it possible for anyone anywhere to take a peek into their closets.

Sumally has also released brand pages and more than 50 brands have joined already. It works sort of like a Facebook page where brands can share newly available products with their core fans who have decided to follow. Very famous brands which have joined include Colette from Paris, Cibone, and Moma Design Store, and they have over 400 followers at present.

The next feature planned to be released is a smaller categorization of Wants and Haves. Users will be able to categorize their wants to something like ?Things I want for my next birthday? or ?Things I?m giving away? or ?My interior goods?. This should make the discovery process a bit easier.

Since Sumally began it has been invite-only in its beta phase in Japan. Most of the current users are from Japan with only 10 percent from outside Japan. Now that it are officially available to everyone, it aims to gain more users from Asia and the United States.

Energy saves multi-band concert at Sherman Theater, and that's a shame

Patent PendingEnergy usually is a very important element to a rock show: Without it, a great-sounding show can be bogged down.

Or a mediocre concert can be elevated, as was the case of Patent Pending headlining an eight-band show Friday at Stroudsburg?s Sherman Theater.

But in the case of the Sherman, that?s a shame, because the show had all the ingredients for a great concert ? not one that needed to be defined by a high energy level.

Whether it was the impending holidays or the waiting ? and sometimes wading ? through what turned out to be a 5 1/2-hour show, many of the bands, including Patent Pending were decidedly off their games. With one exception; we?ll get to that later.

The Long Island, N.Y.-based Patent Pending was all about the energy, putting on a 20-song, 90-minute show that had singer/front man Joe Ragosta frequently crowd-surfing and bounding all over stage. He also incited the crowd not only to jump and form circle pits, but even to do reverse circle pits and a ?crawl of death? in which they split and, rather than ramming into each other in a wall of death, crawled. They also had bubble ?snowstorms? on the Christmas-themed stage and shot confetti streamers into the crowd.

They opened with ?Walk-in Closet? and stormed through ?I Already Know (She Don?t Give a S--- About Me),? which two weeks ago was used on MTV?s ?The Real World.? During ?Shake Weights and Moving Crates,? Ragosta actually brought out a Shake Weight and wiggled it suggestively.

They played ?The June Spirit,? a song they said they hadn?t done in two years, and on which Ragosta inserted lines from Vanilla Ice?s ?Ice Ice Baby? and DJ Jazzy Jeff and Fresh Prince?s ?Parents Just Don?t Understand.?

They even played ?Decemberween,? which they said was the first song they ever played at The Sherman six or seven years ago. And they covered Smash Mouth?s ?Hey Now, You?re a Rock Star,? from what Ragosta said was an upcoming album of cover songs.

It was all great fun, but the band?s songs were decidedly ragged. Ragosta sang off key on virtually every song, even when he wasn?t running around stage, and the band?s music was far tighter at Allentown?s Crocodile Rock Caf? in July.

They did better on ?Spin Me Around,? which Ragosta dedicated to his fianc?e and played alone on acoustic guitar, and the slower ?One Less Heart to Break? before closing the main set with their new single, ?Douchebag,? which is a great song, but also was ragged.

A three-song encore that started with ?Second Family? and included an appropriate ?She?s a Ho Ho Ho, Merry Christmas? was more of the same. But at least encores are expected to be ragged, and the band closed, again, with a lot of energy.

Of the supporting acts, Blairstown, N.J.?s Survay Says, which won two Sherman?s Clash for Cash battles of the bands that I judged, was disappointingly ragged on its eight-song, 30-minute set.

They also showed a lot of energy, but were startlingly loose for a band whose ska sound depends on being tight. The band?s three-man horn section was better accompanying Patent Pending on ?Set the Sun on Fire? than on any of their own songs.

Also disappointing was Refuse the Conformity, a young punk outfit from Nazareth and Easton that was so impressive at the Clash for Cash in July and again opening for Patent Pending at Croc Rock in July.?

They muddled through original songs, but seemed far more confident and proficient on a cover of Green Day?s ?American Idiot? (Patent Pending?s Ragosta joined them to sing) and saved their set with a loopy cover of ?All I Want for Christmas Is You,? with some nice lead guitar.

Goodbye Friday of Lopatcong, N.J., played a nice, chirpy pop-punk set with a good, tight sound. They?ve certainly got the teen-pop attraction part down, and were fun on a cover of Jay Sean?s ?Down.?

But the surprise of the night was Kim?s Comeback of Bethlehem, which showed stunning growth since also opening for Patent Pending at that Croc Rock show in July.

They were tighter, punkier and far more confident on a six-song, 22-minute set, playing originals and covers, including a speedy, fun cover of Taylor Swift?s ?Love Story? (Taking a page from The Summer ?Set) and blink 182?s ?I Won?t Be Home for Christmas.?

They closed with Lit?s ?My Own Worst Enemy,? which also had Patent Pending?s Ragosta on guitar. It had the crowd singing along and moshing. That was a good use of energy.

Iran, Ukraine set to ink $1b oil deal

Ukrainian Inter Naft Gas Prom Pars Company is set to sign a contract, worth around $1 billion, with Iranian Petroleum Engineering and Development Company aiming to develop three heavy crude oilfields in Iran, namely Kooh Mond, Booshgan and Kooh Kaki.

Under the comprehensive development plan, these three oilfields are expected to produce 10,000 to 12,000 barrels of oil per day in the first phase, and about 25,000 barrels per day in the second phase, according to the report, the Mehr news agency reported.

Meanwhile, National Iranian Oil Company's managing director Ahmad Qalebani announced earlier that Iran has excluded developing heavy crude oilfields of the oil industry's first priorities.

Like non-associated oilfields, heavy crude oilfields have also been excluded of the list of prioritized oil development plans, Qalebani added, according to the ISNA news agency.

However, if any entity offers buy-back or finance investments on non-associated or heavy crude oilfields, "we will welcome the offers", Qalebani explained.

"Developing joint oil and gas fields is the first priority of the country's oil industry," he said.

A total of 18 heavy and extra heavy oilfields have so far been discovered in Iran, including Ferdowsi oilfield in the Persian Gulf, which is one of the country's biggest heavy oilfields with proven reserves of more than 31 billion barrels.

Iran's total in-place oil reserves have been estimated at more than 560 billion barrels with about 140 billion barrels of recoverable reserve. Moreover, heavy and extra heavy varieties of crude oil account for roughly 70-100 billion barrels of the total reserves.

Iran holds the world's third largest proven oil reserves and the second-largest natural gas reserves.

The Oregon Ducks football coach has been credited with inspiring many college coaches with his no-huddle offense and up-tempo practices. Even a Super Bowl-winning coach has sung the praises of Oregon?s system.

Now it appears coaches in other sports are also taking notice.

Erik Spoelstra, the coach of the NBA?s Miami Heat, told ESPN he flew his entire coaching staff to Eugene to learn from Kelly. He has now been implementing Kelly?s fast-paced offense on the hardwood with LeBron James, DeWayne Wade and Chris Bosh.

(Spoelstra is originally from Oregon and played basketball for the University of Portland.)

He told ESPN he hatched the idea partially out of lockout-induced boredom.

?The No. 1 thing I was trying to do was learn," Spoelstra said. "I had a lot of time on my hands and I didn't just want to sit there."

(AP) ? Czechs and world leaders paid emotional tribute to Vaclav Havel on Friday at a pomp-filled funeral ceremony, ending a week of public grief and nostalgia over the death of the dissident playwright who led the 1989 revolution that toppled four decades of communist rule.

Bells tolled from churches while a wailing siren brought the country to a standstill in a minute of silence for the nation's first democratically-elected president after the nonviolent "Velvet Revolution."

Havel's wife Dagmar, family members, friends and leaders from dozens of countries gathered Friday at the towering, gothic St. Vitus Cathedral which overlooks Prague. U.S. Secretary of State Hillary Rodham Clinton, French President Nicolas Sarkozy and Britain's Prime Minister David Cameron were among some 1,000 mourners who bowed their heads in front of the coffin draped in the Czech colors.

Czech President Vaclav Klaus, who was Havel's political archrival, and two friends ? Foreign Minister Karel Schwarzenberg and former U.S. Secretary of State Madeleine Albright ? paid tribute to Havel at the cathedral, which dates to the 10th century and has not witnessed a state funeral since 1875.

"We will terribly miss him but we will never, ever forget him," said Albright, who is of Czech origin, in Czech.

In a message read at the funeral by the Vatican's former diplomatic representative in Prague, Pope Benedict XVI praised Havel. "Remembering how courageously Mr. Havel defended human rights at a time when these were systematically denied to the people of your country, and paying tribute to his visionary leadership in forging a new democratic polity after the fall of the previous regime, I give thanks to God for the freedom that the people of the Czech Republic now enjoy," he said.

At the end of the ceremony, 21 cannon salvos were fired when the Czech national anthem was played.

People were applauding when Havel's coffin was then carried by a military honor guard through the cathedral's Golden Gate to Prague's Strasnice crematorium for a private family funeral. The urn with Havel's ashes will be buried at his family's plot at the city's Vinohrady cemetery alongside his first wife, Olga, who died in 1996.

Havel, whose final term in office ended in 2003, died Sunday morning in his sleep at his weekend home in the country's north. The 75-year-old former chain-smoker had a history of chronic respiratory problems dating back to his time in prison.

Since his death, Czechs have gathered spontaneously to lay flowers and light candles at key historic sites such as the monument to the 1989 Velvet Revolution in downtown Prague, and at Wenceslas Square, where Havel once spoke before hundreds of thousands of people to express outrage at the repressive communist regime.

Similar scenes of remembrance played out across the country ? in a show of emotion not seen since the 1937 funeral of Tomas Garrigue Masaryk, Czechoslovakia's first president after the nation was founded in 1918.

"Europe owes Vaclav Havel a profound debt," Cameron said before departing from London. "Havel led the Czech people out of tyranny ... and he helped bring freedom and democracy to our entire continent."

Czechs packed a nearby courtyard at Prague Castle and an adjacent square to watch the funeral ceremony on giant screens.

"He was our star, he gave us democracy," said Iva Buckova, 51, who had traveled from the western city of Plzen. "He led us through revolution. We came to see him for the last time."

Prague Archbishop Dominik Duka, who spent time in jail with Havel under Communism, was leading the funeral mass. He was joined by Vatican envoy Giovanni Coppa and bishop Vaclav Maly, Havel's friend and fellow dissident. Poland's former President Lech Walesa ? who led the anti-communist Solidarity movement ? also attended.

The Czech Philharmonic Orchestra performed parts of Requiem by Czech composer Antonin Dvorak throughout the ceremony.

Braving the freezing cold, thousands of mourners have waited in long lines every day since Monday to file past Havel's coffin.

Several thousand people joined Havel's widow, relatives and friends in a somber procession through the capital Wednesday as Havel's body was transported to the Prague Castle.

In his final years, Havel made only occasional public appearances, and would often say that he had insufficient time to resume his literary work.

The director of the theater where he began as a stagehand in 1958 before becoming a playwright ? and where he said he spent the best 8 years of his life ? told AP he'd started work on one last play this year. It was to be called "Sanatorium."

"He may be able to finish it in heaven," said the director of Na Zabradli, Doubravka Svobodova.

Amazon Releases a Partial Fix for Kindle Fire Bugs (The Atlantic Wire)

As promised, Amazon has given Kindle users an update to fix some (not all) of the tablet's issues. After the Kindle's mid-November debut, owners quickly discovered the budget tablet's many short-comings. It promised a fix in less than two weeks. A week later we have a partial solution.?

Problems the Update Fixes

Sluggish performance plagued fresh-out-of-the-box tablets. But the new update fixes some of the slow browser issues, says?The New York Times's David Pogue, who noted the jerky experience when he first reviewed the tablet. He now reports the carousel -- the virtual shelf for content -- "stops on a dime when you want it," things open with just one tap, the whole tap process is faser, and smoother page turns. In general the whole thing works faster, users told PCWorld's ?Daniel Ionescu.?

Others took?issue with the Kindle's privacy settings. Parents reported concern with having their children (or significant others) seeing all of the tablet's content right-up front in the carousel. The new update gives these sneaky folk the ablity to hide content deep within the tablet, rather than showcase it all on the home screen. And, as for the issue of children racking up bills on their parents' Kindles: Amazon has no added a password lock for WiFi access.?

Amazon doesn't mention any WiFi fixes -- a particularly annoying issue for a device that only runs on WiFi. But?we hear?the software update does the trick.?

Problems the Update Does Not Fix

Though Amazon has added privacy options, with password protection, the update doesn't address all of parental concerns. Some had reported that kids could stumble across raunchy material pretty easily. Amazon does let users set a PIN for in-app purchases. But the new update doesn't make that a device-wide option.

Overall, Pogue and other report a speedier experience. Yet, Pogue still complains that magazine reading still doesn't deliver. "Magazine reading is?still an exercise in frustration," he writes. ?"Far too often, the row of page-navigation thumbnails still thrusts itself on top of what you?re trying to read. " Considering Amazon hopes to make bank on selling things like magazines, it might consider that for its next iteration.

Then, there are the hardware issues -- the fat finger problem, the on/off switch?-- things a software update can't fix.?

We hear the update process is?cumbersome?and?complicated. Ionescu explains the process:

To update your Kindle Fire, Amazon advises to ensure your battery is fully charged and that you are connected to a Wi-Fi network.?You then tap the Quick Settings icon in the upper right corner and then "Sync." Next, a new notification will appear in the upper left hand corner of the drop down notification bar. Select "update" and the 6.2.1 update will automatically download in the background and will be applied when the device is asleep. Amazon also has a set of instructions to install the software manually.

For manual update, users will need a USB cable, Gizmodo's Sam Biddle explains that (annoying-sounding) process:

If you want to dodge Wi-Fi, you'll need to drag a .bin file into a folder within the Kindle after you mount it on your computer as an external drive. Then you have to go to settings and hit update. But only if your battery's full!?
